To detect these types of violations, an expert review of the documentation is required to identify ambiguities and contradictions in terms.

Rapid access to documents can be achieved through the “Contract Details” sheet of the “Analytics” section of the “Analysis of Kazakhstan Public Procurement Data” module. To structure the process, filters can be used to generate specific selections by contracting entities, industries, and Goods, Works, and Services (GWS). Familiarity with the Analytics module can be enhanced by referring to the “Knowledge Base” section.

Note: Initially, for minor discrepancies, one might choose to directly communicate with the Contracting Entity to address the matter without escalating to higher authorities. Minor discrepancies are understood as those the Contracting Entity can easily rectify—like correcting typographical errors in specifications, clarifying a plan item, or specifying the quantity of goods.

“Supplier: However, from the first day of the contract's enactment, the State-Owned Enterprise (SOE) has been making unjustified demands on the supplier for the delivery of spare parts for this equipment, amounting to 200 million tenge, which are not mentioned in the contract. Following this, they filed a lawsuit alleging that we're an unscrupulous supplier, supposedly due to non-compliance with contract terms.
Contracting Entity: In turn, representatives of the SOE "Information and Production Center" reiterated in a meeting that they believe the supplier failed to meet the contract's terms. As a result, they intend to appeal the decision of the Specialized Inter-District Economic Courtof Almaty. According to them, previously, a German company maintained the equipment and procured spare parts for repairs on its own.”
